Patent filing requirements

(Priority claiming applications must be filed within 12 months of the earliest priority date)

Minimum requirements for filing

  • Details of applicant(s) and inventor(s) (full name, address, and nationality)
  • Specification (including title, description and claims) and abstract (not exceed 150 words) of the invention in native language (preferably English)
  • Drawings (if any)
  • Number and filing date of PCT application in the case of international application
  • Number, date and country of priority application(s) if priority right is claimed
  • Search Report, which is issued by any patent examination body in a foreign country or by a relevant international organization, may be considered by the Lao Patent Office (if available)
  • Notarized Power of Attorney
  • Notarized Deed of Assignment if the applicant and the inventor are not the same
  • Lao translation of specification and abstract of the invention within 90 days from the filing date

Industrial Design filing requirements

(Priority claiming applications must be filed within 6 months of the earliest priority date)

  • Details of applicant(s) and designer(s) (full name, address, and nationality)
  • Title or indication of the product(s) to which the design is applied
  • The international classification code under the Locarno Agreement. We can prepare it for you
  • Drawings of the design, or 07 copies of original photographs (including perspective, front, back, top, bottom, left and right view) of the product(s) to which the design is applied
  • Brief description of the design in English
  • Certified copi(es) of priority application(s) if priority right is claimed
  • Notarized Power of Attorney
  • Notarized Deed of Assignment if the applicant and the designer are not the same

Lao Trademark Filing Requirements

(Priority claiming applications must be filed within 6 months of the earliest priority date)
Minimum requirements for filing
(Kinds of marks registerable in Laos are trademark, service mark, collective mark. One trademark application covers goods/services in only one class)

  • Details of applicant(s) (full name, address, and nationality)
  • A description of the mark including meaning and colors claimed; transliteration into Roman letters, if necessary
  • 01 print for black and white mark or 20 prints for color mark with the size between 5 cm and 10 cm
  • List of Goods or Services and, preferably, their International Classification(s)
  • A certified copy of priority document and its English translation if the Paris Convention Priority Right is claimed
  • Regulation governing the use of mark if the mark is collective mark
  • A fax copy of notarized Power of Attorney

Documents that may be late filed

  • Original notarized Power of Attorney within 60 days from the filing date

Requirements for renewal

(Request for renewal must be filed within 6 months before the expiry date)

  • A notarized Power of Attorney
  • A copy of Certificate of Industrial Design or Certificate of Trademark Registration
  • 01 print for black and white mark or 20 prints for color mark with the size between 5 cm and 10 cm

Requirements for recodals

Recordal of an assignment/license agreement

  • Notarized Powers of Attorney from the Assignor and the Assignee
  • An original or a certified copy of the Agreement, including appendix or appendices (if any) and their English translations
  • Copy of Patent, Petty patent, or Certificate of Industrial Design/Trademark

Recordal of changes of name/address of the owner and/or the inventor

  • Notarized Power of Attorney with the new name and/or address of the owner and/or the inventor
  • Original notarized Statutory Statement
  • Copy of Patent, Petty Patent or Certificate of Industrial Design/Trademark
