Patents

Priority Claiming Applications

Priority claiming applications must be filed within 12 months of the earliest priority date.

Minimum requirements for filing:

  • Details of applicant(s) and inventor(s) (full name, address, and nationality)
  • Specification including title, description, claims, and abstract (max 150 words) in native language, preferably English
  • Drawings (if any)
  • PCT application number and filing date for international applications
  • Number, date and country of priority application(s) if claiming priority rights
  • Search Report from foreign patent body or international organization (if available)
  • Notarized Power of Attorney
  • Notarized Deed of Assignment if applicant differs from inventor
  • Lao translation of specification and abstract within 90 days from filing date

Non-Priority Claiming Applications

Minimum requirements for filing:

  • Details of applicant(s) and inventor(s) (full name, address, and nationality)
  • Specification including title, description, claims, and abstract (max 150 words) in native language, preferably English
  • Drawings (if any)
  • Search Report from foreign patent body or international organization (if available)
  • Notarized Power of Attorney
  • Notarized Deed of Assignment if applicant differs from inventor
  • Lao translation of specification and abstract within 90 days from filing date

Industrial Designs

Filing Requirements

Priority claiming applications must be filed within 6 months of the earliest priority date.

Minimum requirements for filing:

  • Details of designer(s) and applicant(s) (full name, address, and nationality)
  • Title or indication of product(s) to which the design is applied
  • The international classification code under the Locarno Agreement. We can prepare it for you
  • Drawings of the design, or 7 copies of original photographs (including perspective, front, back, top, bottom, left and right view)
  • Brief description of the design in English
  • Certified copies of priority application(s) if claiming priority rights
  • Notarized Power of Attorney
  • Notarized Deed of Assignment if applicant differs from designer

Trademarks

One trademark application covers goods/services in only one class. Registerable mark types: trademark, service mark, collective mark.

Filing Requirements

Priority claiming applications must be filed within 6 months of the earliest priority date.

Minimum requirements for filing:

  • Details of applicant(s) (full name, address, and nationality)
  • Description of the mark including meaning, colors claimed, and Roman letter transliteration if necessary
  • 1 print for black and white mark or 20 prints for color mark (5–10 cm size)
  • List of Goods or Services to be protected and, preferably, their International Classification(s)
  • Certified copy of priority application and English translation thereof if claiming Paris Convention priority
  • Regulation governing the use of mark if the mark is a collective mark
  • Faxed notarized Power of Attorney

Documents that may be late filed:

  • Original notarized Power of Attorney within 60 days from filing date

Renewal and Recordal

Vietnamese requirements for renewal:

Request for renewal must be filed within 6 months before the expiry date.

  • Notarized Power of Attorney
  • Certificate of Industrial Design or Trademark Registration (copy)
  • 1 print for black and white mark or 20 prints for color mark (5–10 cm size)

Recordal of an assignment or license agreement:

  • Notarized Powers of Attorney from both Assignor and Assignee
  • Original or certified copy of the agreement with appendices and English translations
  • Patent, Petty Patent, or Certificate (copy)

Recordal of changes of name/address:

  • Notarized Power of Attorney reflecting new name/address
  • Original notarized Statutory Statement
  • Patent, Petty Patent, or Certificate (copy)
